These Terms and Conditions set out the rights and obligations relating to the services and information that SERVIAM (with its registered office at Steenweg op Aalst 125, B-9620 Zottegem, registered in the Belgian Crossroads Bank for Enterprises under number 0676.485.126; referred to below as “Château de Braffe”) makes available through its website at chateaudebraffe.be (the “Website”). In particular, they govern the rights and obligations of Château de Braffe and the lawful user(s) in relation to the information and services provided and/or processed by Château de Braffe directly or indirectly through the Website.
The general purpose of the Website is to provide general and specific information about the products, services and activities of Château de Braffe, including news, events and projects that it organises or helps to organise or in which it is involved. The Website does not contain statements that are binding on Château de Braffe or on which users may rely.
Through the Website, Château de Braffe also processes and provides relevant information relating to its users. This information may have been collected by Château de Braffe in the course of its activities, provided directly by users, or obtained indirectly through public channels such as social media.

A user may access and use the services when they meet the access requirements for the relevant services, systems, applications and/or data. Château de Braffe may at any time independently and at its discretion check and decide whether a user meets these requirements. If they no longer do, Château de Braffe may suspend or terminate the products or services it provides, in whole or in part, without the user being entitled to compensation or a refund.
Unless expressly agreed otherwise, the obligations relating to services supplied by Château de Braffe to the user are obligations of reasonable effort. When providing its services, Château de Braffe will apply generally accepted professional standards, taking account of the state of the art. If the parties have entered into a separate written agreement, any minimum service levels agreed there in terms of quality or quantity constitute obligations to achieve a result and take precedence over these Terms and Conditions.
Because the availability and proper functioning of systems and applications made available by Château de Braffe to the user may depend on third-party systems, applications and data for which Château de Braffe has no agreement, it gives no guarantee that all its systems, applications and/or data will be accessible continuously or even temporarily.
In light of the above, Château de Braffe cannot be held liable for unavailability of the Website or for incomplete or incorrect information, except in cases of fraud or deceit directly attributable to Château de Braffe.
Château de Braffe may subcontract all or part of its products or services to a third party without the user’s consent. The parties expressly agree that, unless Château de Braffe agrees otherwise in writing, such a subcontract creates no obligation or commitment towards the customer. Château de Braffe expressly accepts that it remains liable for services subcontracted to one or more third parties, unless otherwise agreed in writing.
These Terms and Conditions are governed exclusively by Belgian law. In a dispute between the parties relating to information made available by Château de Braffe through the Website, only the courts specified in the invoice terms shall have jurisdiction. The parties will nevertheless make reasonable efforts to settle the dispute amicably first.
